The Small Business Administration issued a final rule effective June 30, 2016 that implements several changes in federal small business contracting. One that impacts AttainIt, its customers and suppliers, and many other small businesses, is the extension of the non-manufacturer rule waiver for small business set asides. Currently, the limit is $25,000. After the rule change, nonmanufacturers such as AttainIt can sell the federal government products manufactured by any size business without regard to the place of manufacture and without a waiver up to $150,000. Other laws such as the Buy American Act and Trade Agreements Act may still apply depending on the agency and contracting vehicle.
AttainIt wants to sell the Army a product manufactured by a large business in Germany for $30,000.
Current state: not possible to issue a small business set aside since it is not manufactured in the U.S. and the amount is above the $25,000 threshold (unless there is a class waiver or the agency wants to wait weeks to request an individual waiver)
After June 30: totally OK to issue a small business set aside!
